Welcome to ScholarLink. We are an independent service provider officially authorised by a network of educational institutions ("Institutions") to represent them and facilitate the student application process.
These Terms of Service ("Terms") govern your use of our application processing and student advisory services ("Services"). By engaging ScholarLink, you ("the Student" or "you") acknowledge that you have read, understood, and agree to be bound by these Terms.
As an authorised representative of our partner Institutions, ScholarLink provides the following services:
Providing official information and guidance on suitable Institutions and programs
Assisting with the preparation and submission of application materials directly to the Institution's admissions system
Facilitating communication between you and the Institution
Providing accurate advice on admission requirements, deadlines, and policies
You agree to the following:
Provide accurate, complete, and current information throughout the application process
Respond promptly to requests for information or documents from ScholarLink or the Institution
Read and understand all requirements, policies, and terms set by the Institution you are applying to, including their refund policies
Ensure you meet all deadlines set by the Institution and ScholarLink
While ScholarLink is an authorised representative for our partner Institutions, we act as an intermediary. The ultimate contractual relationship for your education is between you and the Institution. Therefore:
Admissions Decisions: All final admissions decisions are made solely by the Institution.
Visa Decisions: All visa decisions are made solely by the relevant government authorities.
Institutional Actions: ScholarLink is not liable for any actions, delays, errors, or omissions by any Institution.
This section explains your financial responsibilities. Please read it carefully.
All tuition fees, deposits, and other related financial obligations are contracts solely between you and the educational Institution. All payments must be made directly to the Institution as per their instructions. ScholarLink does not collect tuition fees on behalf of Institutions.
ScholarLink, while representing the Institution for recruitment purposes, is not a party to the financial contract between you and the Institution. We are not responsible for the payment, reimbursement, or refund of any tuition fees or deposits you pay. The obligation, process, and timing for issuing any refund are solely determined by the policies and procedures of the respective Institution.
As your service provider and as a representative of the Institution, we will use reasonable efforts to facilitate and advocate for your refund request according to the Institution's published policies. This includes guiding you through the process, providing necessary documentation to you and the Institution, and communicating your request to the appropriate contacts at the Institution.
You acknowledge and agree that any refund is subject to the terms and processing times of the Institution. ScholarLink cannot expedite this process beyond official channels and does not guarantee the outcome or timing of a refund. You must wait for the Institution to process and issue the refund directly to you.
To the fullest extent permitted by law, ScholarLink shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:
Your use of our services
The decisions of an Institution
Your loss of tuition fees or deposits
Any delay, rejection, or denial of your application by any Institution or government authority
You agree to indemnify and hold harmless ScholarLink and its employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of:
Your use of our services
Your violation of these Terms
Your violation of any rights of a third party
These Terms shall be governed by and construed in accordance with the laws of Portugal, Nigeria, Mauritius, and Kenya without regard to their conflict of law principles. If you are not located in any of these countries, the default governing country shall be Portugal.
We reserve the right to modify these Terms at any time. Any changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after any change constitutes your acceptance of the new Terms.
